I cant pay these loans back and I have post dated checks with the payday loan companies. Im afraid they could prosecute me for the bad post dated checks. What is going to be the best way to handle this situation?

Immediately send them a letter via certified mail, keep a copy for you yourself.
State that those post dated checks should not be cashed and you would like them returned to you.
You could put stop payments on those checks, or close the account. Again you could put that in your letter.
I am not sure how that works, as this is more a loan, rather than the normal bad check problem.
But it is a good question, and you need to protect yourself.

You are not going to get an installment loan to pay off payday loans if you have bad credit.

In fact, you had to get payday loans because that was the only type of loan you could get due to your credit then..and now you cannot even pay the payday loans, and your credit is still bad. If you couldn’t get a *normal* loan back then, you sure won’t be getting one now.

I took got a payday advance loan from cashnetusa.com I believe it was and It was due to be paid today. I had the intentions to pay it and now i dont have the money to. They tried to take the money out of my checking account and it was denied, leaving me with a fee from my bank because it was returned. I closed my bank account to keep this from continuing. What can they do if I am unable to pay this back? And in about how much time would they take these actions?

They can sue you for the money plus interest, they can have the court order/enter a judgement against you to pay them back all the money, interest + legal fees. If they are very nasty they will wait until the amount goes to above the smalll claims court limit then take you to big court and sue you for more, they can alternatively sell your credit to an annoying agency who will call you day and night, show up at your work, and tell everyone you know that you owe them money (including your boss, family, friends, etc). They can also go back and investigate yoour loan application and if they find any false information on it they can give it to the police and charge you for fraud if either they or the police find you lied, they can ruin your credit, this can also increase your cost of other credit cards or cause you to loose credit altogether. In some states it is a crime to write a check with nsf or insufficient funds so that alone could be enough to land you 90-180 days in jail. they can nail you for fraud if for example you realy do not have a job or your pay check is not what you said it was or if you misrepresented things on your application.

We are desperately waiting for a re-enlistment bonus we are expecting but in the meantime need a quick loan to get us by for somethings that have come up. Payday loans dont seem to help those in the military anymore and I know payday loans are not a good idea but we also know we will only use this until the bonus comes thru . Anyone know where we can get a quick guaranteed loan for personnel in the reserves?

I wouldn’t do this. Why spend unnecessary? You are betting on receiving something that has yet to come. What would happen if something goes wrong for you? This is like writing a check and not having enough money in your account to cover it.

What happens if someone took out a payday loan in my name?

I’m going through a nasty divorce that has been dragging on for almost a year. A couple of days ago, both my brother and sister got phone calls from someone claiming to be a collection agency for a payday loan company saying that I had taken a payday loan and failed to pay on it. I have never taken a payday loan and my attorney cannot take action until I have something in writing. What can I do?

It does not sound like an actual collection company, (actual collection companies can’t state they are calling because of an unpaid debt unless they are talking to the lendee… fdcpa guidelines), don’t know what it is but it sounds fishy. If you do talk to this person DO NOT give out any personal information, and inform family/friends not to give out theirs. Given that you are going through a divorce my best guess (and it is only that), is that it is a private investigator from your former signifigant other. Best of luck.

My bf got a call today from a payday advance place & the lady on the phone said that they would send the sheriffs office out to pick him up for non payment of a payday advance loan that is 3 years old & he paid all but like 120 $ back . Can he be arrested for this or are they just threatening to try & get him to pay ?

These are illegal threats. No debt collector has the power to send the sheriff out to collect a debt. Many debt collectors are under extreme pressure to meet quotas to keep their jobs, so that’s why many of them skirt the laws in order to collect on old defaults.

Normally, you should pay your obligations, but you should not deal with or pay collection agencies that engage in illegal tactics like this.

– Get a tape recorder and start recording their calls. When they call, read the following disclaimer:
– Be advised this call is being recorded. If you do not consent to being recorded, you need to terminate this call. Continuation of this phone call after officially being informed that it is being recorded implies consent to be recorded. This recording will be used to pursue Fair Debt Collection Practice Act violations in a court of law.
